In addition to its recognized skills in trial, Fowler White possesses equal proficiency in state and federal appellate court proceedings. Under the direction of a board certified appellate lawyer, the Appellate Group is a team of lawyers specializing in practice before state and federal courts. Because every matter handled at the trial level may be appealed, this team provides litigation support and legal analysis on procedural and substantive issues that may arise during the course of representation.

Fowler White's experienced appellate specialists proficiently address the recognition and preservation of error committed by lower tribunals and present argument concerning the presence or absence of error to state and federal courts through brief writing, extraordinary writs, motion practice and oral argument. The Appellate Group routinely evaluates and advises regarding appellate issues or remedies in connection with proceedings in the lower tribunal prior to the initiation of the appellate process, which is a critical resource for Fowler White's valued clients and its trial attorneys.

Fowler White's appellate practitioners are also knowledgeable and experienced with respect to the application of specialized rules of appellate procedure and participation in mandatory appellate mediation programs. Furthermore, in an increasingly complex legal and regulatory environment, the Appellate Group closely follows current developments in the law and evaluates the effects of those changes for our clients.

The Appellate Group lawyers were instrumental in the formation of the Appellate Practice Section of the Florida Bar, which provides a forum for lawyers and judges to work together on issues affecting appellate courts. The shareholder in charge of this group was a founding member of the Appellate Practice Section, was the Section’s inaugural chair and has continuously served on the Section’s Executive Council since its inception. In addition, other members of the Appellate Group have actively participated in the formation and development of the Section and served as officers and committee members for the Section.

The geographical parameters of the Appellate Group’s expertise ranges from multiple circuit courts and district courts of appeal in Florida, the Florida Supreme Court, multiple federal district courts in Florida, the Eleventh Circuit Court of Appeals, and the U.S. Supreme Court. The Appellate Group has successfully handled several significant cases for various important business sectors, including the health care sector, the construction industry, casualty and automobile insurers, and myriad other matters for industries and clients represented by Fowler White's other practice groups.

June Galkoski Hoffman is a shareholder with Fowler White Burnett based in its Miami office where she chairs the firm's Appellate Practice Group. Ms. Hoffman has approximately 15 years of experience in the appellate and trial support arena and has been Board Certified in Appellate Practice by The Florida Bar as a specialist in appellate practice since 2003. She has served as lead appellate counsel in more than 200 civil appellate proceedings in state and federal appeals courts, including administrative and bankruptcy appeals. Significantly, Ms. Hoffman successfully represented the Executor of the Estate of Anna Nicole Smith in expedited, nationally televised appellate proceedings in Florida and presented the winning argument to support affirmance despite analytical error in the trial court's decision. She has appeared on Larry King Live, the Today Show, Fox News with Greta Van Susteren and Court TV as an expert in appellate practice.

Ms. Hoffman is recognized as a premier appellate attorney in Florida by her peers in the 2007 editions of Florida Super Lawyers and South Florida Legal Guide's Top Lawyers. Ms. Hoffman represents clients in all phases of civil jury trials and appeals and regularly practices before each of Florida's District Courts of Appeal, the Florida Supreme Court and the federal Eleventh Circuit Court of Appeals. In addition to traditional appellate practice, Ms. Hoffman's practice includes extensive participation at the trial court level. She serves as legal issues counsel to trial attorneys both inside and outside the firm by providing extensive litigation support and jury trial consulting concerning preparation and presentation of dispositive motions, motions in limine, jury instructions and post-trial motions, as well as preservation of error issues. Ms. Hoffman has extensive substantive expertise in areas of tort and insurance law, with particular emphasis on medical malpractice, products liability and personal injury defense. Ms. Hoffman also serves on the Executive Council of The Florida Bar's Appellate Practice Section and is a past Vice President of the Dade County Defense Bar Association. She has also served on the St. Thomas University School of Law Alumni Council and as a guest lecturer on Appellate Practice and Advocacy at local South Florida law schools. Her charitable involvements have included fundraising initiatives with the March of Dimes Walk America and the Make A Wish Foundation.
