The Dispute Resolution Team handles a wide variety of complex commercial disputes in federal and state courts and alternative dispute resolution throughout this region and across the United States. We stress client communication so that our clients and co-counsel and referring counsel continuously receive current information and developments at all litigation stages, including discovery, motion practice, class certification, settlement, trial preparation, trial and appeal. Our Dispute Resolution Team has handled multimillion dollar class action disputes and lender liability cases. The Team represents regional, national and international clients ranging from Fortune 500 companies to entrepreneurs. We regularly represent household names in the equipment leasing industry headquartered throughout the United States.
Our Team regularly litigates a wide range of corporate disputes, such as fights over ownership and control, securities fraud and shareholder derivative claims. Our Team members bring specialized expertise in business torts such as fraud, breach of fiduciary duty, theft of trade secrets, and tortious interference with business relationships and contracts, to support more aggressive theories and recoveries in this area. The Team also features specialized expertise in employment law and non-compete cases that helps clients regarding employment termination cases, non-compete and other covenant enforcement, and various other claims employees assert. In the intellectual property realm, we represent companies, investors, franchisors, franchisees and individuals seeking to enforce (or challenge and invalidate) patents, trademarks, copyrights and trade secrets. The Dispute Resolution Team also has extensive experience in matters involving all aspects of real estate development, including disputes involving developers, governmental agencies, contractors, buyers, sellers, brokers, title companies and lenders.
Our Dispute Resolution Team offers a wealth of knowledge and experience in white collar crime detection, investigation, enforcement, prosecution, resolution, and criminal defense. Members of the Team have tried well over 100 criminal jury trials to verdict, and have handled all related pre-trial and post-verdict proceedings in these and hundreds of other cases as well. Their working knowledge of complex litigation is a significant asset in the development of successful investigative strategies, and both pro-active and defensive strategies to actions involving allegations of white collar crime or its civil equivalent. This experience also includes governance issues and regulatory compliance and enforcement.
Two members of the Team have extensive experience as prosecutors, grand jury advisers, and defense lawyers. Melanie Hines served for twelve years as the Statewide Prosecutor, the constitutionally designated prosecution arm of Florida’s Attorney General, with the responsibility to supervise prosecutors around the State in complex cases. She previously served as an Assistant Statewide Prosecutor for 4 years, and an Assistant Public Defender for 6 years, handling trial work and appeals. Tom Sadaka, served for 7 years as Special Counsel for Computer Crimes and Identity Theft Prosecutions in the Florida Office of Statewide Prosecution and oversaw all criminal prosecution and investigation of computer and Internet related crimes and identity theft cases handled by the Office.
The Team also works closely with the Firm's Business Reorganization Team to spearhead a wide variety of adversary proceedings in Bankruptcy Court and other bankruptcy related litigation. The Team collaborates with the Transaction Team both to lend litigation expertise to negotiating pending deals and potentially contentious issues, and to use their expertise to conclude complex settlements. We collaborate with the Administrative Law Team for litigation of administrative law matters. The Dispute Resolution Team members increasingly focus on alternative dispute resolution mechanisms, including mediation and arbitration. When used appropriately and at the right time, these methods can help us execute our mission of providing creative and effective business solutions and counsel.

James D. Gassenheimer is a shareholder in Berger Singerman’s Dispute Resolution Team resident in the Miami office. Mr. Gassenheimer is Board Certified as a Civil Trial Lawyer by The Florida Bar, the highest level of recognition by The Florida Bar of the competency and experience of attorneys in the areas of law approved for certification by the Supreme Court of Florida. He is also Board Certified as a Civil Trial Lawyer by the National Board of Trial Advocacy. Mr. Gassenheimer began his law career as an associate attorney with the law firm of Fowler White Burnett. He was a partner with Mase & Gassenheimer P.A. from 1998 to 2005. Prior to joining Berger Singerman, Mr. Gassenheimer was with The Gassenheimer Law Firm from 2005 to 2007 where he regularly tried cases and argued appeals for his corporate clients throughout the State of Florida in both State and Federal Courts. He has tried over one hundred jury and non jury matters during his years in private practice. Mr. Gassenheimer has handled a wide variety of litigation matters including complex commercial litigation matters, real estate litigation, employment litigation, class action litigation, all types of tort litigation and has represented creditors in bankruptcy matters. Additionally, he has extensive experience representing clients at corporate depositions and has been regularly asked by clients to speak on preparing for and testifying at corporate depositions.
Mr. Gassenheimer is a graduate of Brown University, B.A. (1989); and the University of Miami School of Law, J.D., cum laude (1992) where he was selected to receive the Order of the Coif, a national honor society for law school graduates who attend member schools. Each year it extends invitations to the top 10% of graduating law students by grade point average. He has been a member of The Florida Bar since 1992 and has served on the Admiralty Law Committee and the Code and Rules of Evidence Committee. Mr. Gassenheimer is admitted to practice before the United States Court of Appeals for the Eleventh Circuit and the United States District Courts for the Southern and Middle Districts of Florida.
Mr. Gassenheimer is AV Peer Review Rated by Lexis/Nexis Martindale Hubbell and has been recognized by Law and Politics as a "Florida Super Lawyer" in the area of Civil Litigation. He is a fellow of the Litigation Council of America, a trial lawyer honorary society composed of less than one-half of one percent of American lawyers. Fellowship in the LCA is highly selective and by invitation only. Mr. Gassenheimer was the recipient of the Pro Bono Service Award in recognition of continuing support and outstanding contribution to “Put Something Back,†a joint pro bono project of the Florida Eleventh Judicial Circuit and the Miami-Dade County Bar Association in the area of Family Law, May 2002.
