The Tax Group centers on the following tax related areas: tax planning and structuring business planning, tax controversy, estate planning and probate administration. Fowler White has substantial depth in the tax area.

The tax controversy portion of the Tax Group involves representing clients in income tax, corporate tax, estate and gift tax and exempt organization matters. The Tax Group has represented thousands of clients and appeared before the Tax Court, federal district courts, and state courts and has dealt directly with the Internal Revenue Service at the Agent, Appeals and District Counsel levels. Fowler White has worked in collection matters (including determinations with respect to the imposition of the 100% penalty in regard to employment and excise tax matters), withholding exemptions in the case of non-resident aliens, exempt organization matters (including recognition of status, declaratory judgments and the use of such organizations for estate planning purposes) and the accumulated earnings tax issues.

In the probate area, the Tax Group represents clients as petitioners, claimants or as interested parties before state probate courts in Florida.

In the estate planning practice area, which includes the analysis of estates and determining the estate plan that will best meet the client’s requirements while reducing income, estate and gift taxes to a minimum, the Tax Group excels. This program includes tax exempt organizations, family limited partnerships and other tax and estate and tax planning structuring.

The Tax Group structures corporate, real estate (including like-kind exchange transactions under Section 1031), commercial and individual (including transactions involving resident and nonresident aliens) transactions with an emphasis on the tax implications of such transactions.

Members of the Tax Group have lectured on various tax-related subjects, including partnership taxation, and written articles concerning various aspects of tax law (“Stopping Internal Revenue Service Administrative Collection Efforts,” Tax Notes May 25, 1998; “Special Allocations and Allocations Relating to Varying Interests,” Florida Bar Continuing Legal Education; “Deductions for Additions to a Bank’s Bad Debt Reserve & The Representation Loan Base,” Taxes, The Tax Magazine; and “The Federal Income Tax Significance of Being a POW or MIA,” Taxes, The Tax Magazine).
